Elder Law Services

The biggest surprise for most people toward the end of their lives is when they learn that Medicare is not going to pay for assisted living when they become unable to care for themselves.

From Candice:

I will never forget the first time I helped a client to qualify for Medicaid after she learned that Medicare was not going to pay for the assisted living that she desperately needed. Not only did she have to sit through a bunch of degrading and embarrassing questions about her ability to care for herself, but she was also dismayed to learn that she would have to spend down most of her assets before she would qualify for Medicaid. This meant paying her caregivers out of pocket until the money was gone. Although we were able to do a spend-down plan that involved some gifting of assets to her daughter, something she said has always stuck with me: “My husband and I worked our whole lives to be able to save enough money to live on and leave something for the kids. We thought we did everything right. I’m glad he’s not here to see this.” I knew that there were millions of seniors out there who would learn the same thing that my client learned, and that their families would suffer because of it.

We help people to protect their assets ahead of time, so that when the time comes when they need assisted living, they can qualify for Medicaid and/or VA benefits while preserving their hard-earned assets to pass on to their loved ones. We also help people who have an immediate need to qualify for Medicaid and/or VA benefits to create a spend-down plan that maximizes spending on things they need and that are allowable under the rules, as well as gifting to loved ones that we plan to pay a penalty to accomplish. These are complicated legal matters that you cannot accomplish alone.

We offer a complimentary 15-minute phone call to get your questions answered, and you can schedule a lengthier Elder Law Planning session for a fee of $450.00, in which we will go over all of your personal information like medical diagnoses, health concerns, income, assets, family information, wishes for long-term care, and determine whether pre-planning for Medicaid and VA benefits is for you, or whether you need a spend-down plan to qualify for Medicaid or VA benefits sooner, as well as assistance with applying for those benefits.
