Now, first things first: I have some tea to spill. Do you know which group of people is the absolute worst at estate planning?

And the answer is…

Lawyers!

Isn’t that absurd? Here’s why lawyers are the absolute worst at estate planning.

1. Lawyers think they can do their own estate planning, even when they don’t practice in that field of law. It’s wild to me, because I would never try to do my own divorce or criminal defense or any other area of law I don’t have experience in. But lawyers who don’t practice estate planning think about it the same way the general public does—that it’s something they can easily DIY, that they have a “simple” estate, and that they can just Google some things to understand what they’re doing. So they either spend so much time doing “research” that they never actually end up doing their estate plan at all, or they end up with some internet forms they may have tweaked a bit but that don’t really address problems they didn’t know they had because they didn’t get experienced counsel. Either way, it ends up being a big mess.

2. Lawyers’ families always assume they have their shit together, even though they rarely do. I can’t tell you how many clients I have who assure me that their parents or other family members surely have their planning in place because they’re lawyers. So they never even ask about it. They just assume it’s all handled.

Isn’t that funny? I started realizing it a few years into my practice. Now I’m rather impressed when I have lawyers who hire me to do their planning. It shows that they know enough to know what they don’t know, and that they’re smart enough to hire someone who does.

So there’s a fun tidbit of info for you that is useless for most people. If you do happen to have a lawyer in your life and you want to know if their estate planning is messy, find out if they used an estate planning lawyer or not. If they didn’t, I can practically guarantee it’ll be messy.
